TERMS OF USE

These Terms of Use govern access to and use of e-soundtrax.com (the “Site”) and services offered by e-soundtrax (the “Artist”). By creating an account, using account-only features, purchasing a license or using a Site service, you agree to these Terms, the Privacy Policy and the specific license terms that apply to your purchase (together, the “Agreement”).

1. Account and access

You may explore the catalog without purchasing a license. A Free account provides the free features currently available, including listening and, when enabled, downloading watermarked previews to evaluate music. A Free account does not by itself include watermark-free audio or a usage license.

You must provide accurate information, use an email address that belongs to you and protect your credentials. The account is personal to you or the entity you legitimately represent and may not be shared in a way that allows third parties to act as independent license holders.

2. Current licenses and products

License V2 products are one-time purchases. Current products may include Single Project, Pro Project, Creator Lifetime and Pro Lifetime. The exact scope of each purchase is shown before payment and is fixed by the specific terms accepted at checkout, the product purchased, the License Holder and, where applicable, the certificate issued.

Standard prices, promotions, welcome offers, upgrades and loyalty offers may differ according to eligibility, purchase history, product and timing. A conditional promotion does not entitle every account to the same price and does not by itself create a retroactive price adjustment, credit or refund.

3. Historical contracts and plans

Subscriptions, Lifetime purchases, licenses and other benefits acquired before License V2 retain the rights granted under the contract in force when they were acquired. These Terms do not retroactively reinterpret or reduce those rights.

Active historical subscriptions continue under their original conditions for the covered period. Where applicable, a historical account may receive additional V2 benefits or an upgrade offer; those benefits are additive and do not replace broader historical rights.

4. Payments

Online payments are processed by third-party providers, currently PayPal where available. e-soundtrax does not need to store your complete card or payment-account credentials. We retain the identifiers, amounts and statuses needed to confirm, reconcile and document orders, licenses, refunds, disputes and accounting records.

A License V2 entitlement becomes active only after the applicable payment is confirmed. A failed, cancelled or incomplete payment attempt does not grant license rights.

5. Refunds

Unless mandatory applicable law provides a different right, you may request a refund within 3 calendar days after purchase, provided that you have not downloaded the licensed watermark-free audio and no license certificate has been issued for that purchase. Once licensed digital content has been delivered or used, the request may be denied.

A refund, reversal, dispute or evidence of fraud may suspend or revoke the entitlement and certificates associated with that purchase, subject to the specific license terms and applicable law. This does not remove independent historical rights arising from a different purchase.

6. Intellectual property

The music, recordings, text, design, trademarks, logos and other Site content are protected by copyright and other intellectual-property rights. Purchasing a license does not transfer ownership of the composition or recording; it grants only the usage rights described in the applicable license.

7. Prohibited uses and AI training

You may not redistribute or resell music as standalone audio or stock, claim authorship, register it in Content ID or another claiming system as your own, or distribute it as a new standalone song or music release. You may not use e-soundtrax music or content to train, develop or improve artificial-intelligence, machine-learning or similar systems without express written authorization.

8. Breach

We may limit or suspend access to an account or related rights where there is fraud, a material breach of the Agreement, unauthorized use or a legal obligation requiring action. Where reasonably possible, action will be limited to the affected rights or purchases.

9. Third-party services

Some functions depend on third parties, for example PayPal for payments or Google for sign-in. Those providers may apply their own policies and terms. e-soundtrax does not control their services or guarantee permanent availability.

10. Site and catalog availability

The Site and catalog are provided “as is” and may change, add or remove content. We make reasonable efforts to maintain the service but do not guarantee uninterrupted availability. Removal of a track from the catalog does not expand or alter rights previously granted to projects already licensed under their applicable terms.

11. Changes to these Terms

We may update these Terms, the Privacy Policy or public documentation. New versions will be published on the Site and material changes may be notified where appropriate. A general update does not retroactively reduce rights already granted by a specific accepted and paid license.
